SJPL Digitization Station Policy

• To use the Digitization Station, patrons must sign this form and make an appointment to use the equipment. To maximize their experience, patrons should review the SJPL Digitization Station instructional resources before their appointment.
• Patrons must save their work on a personal, external source or device. The Digitization Station computer resets after each session. Patron files cannot be stored on library computers.
• Patrons are responsible for complying with all applicable copyright and other intellectual property laws. Patrons may not use the Digitization Station to reproduce materials in violation of copyright or other applicable law. SJPL staff cannot provide legal advice or determine whether a particular use is lawful.
• Digitization Station appointments are limited to three hours and cannot be expanded. Patrons may reserve more than one appointment at a time, but priority may be given to first-time patrons.
• Patrons aged 13 and under must have a parent or guardian present with them while using the Digitization Station.
• The patron who books the appointment is responsible for ensuring that all members of the patron’s group comply with this Policy. Patrons will be responsible for damage to equipment resulting from misuse, negligence, or failure to follow SJPL staff instructions.
• SJPL is not responsible for the loss of or damage to personal property brought into the Digitization Station space.
• Food and drink are not allowed at the Digitization Station.
• Staff may inspect the materials brought into the Digitization Station space to ensure that they will not damage the equipment.
• The Digitization Station is a Do-It-Yourself space. Staff can provide basic information and instruction about the resources, but they will not conduct the digitization for you.
• The Digitization Station is to be used only for personal purposes. It is not to be used for commercial purposes.
• SJPL reserves the right to refuse or terminate use of the Digitization Station when a patron fails to comply with this Policy, staff instructions, or other applicable SJPL policies, or when continued use could damage equipment or create a safety risk.

SJPL Digitization Station Patron Release

In consideration for participation in the activities of SJPL, Patron agrees to the following waiver and release:
1. Assumption of Risk. Patron acknowledges that use of the SJPL Digitization Station and its equipment involves certain risks, including the risk of damage to original materials, personal property, or electronic storage devices; loss, deletion, corruption, or alteration of digital files or data; equipment malfunction; and personal injury associated with the handling or operation of equipment. Patron understands that SJPL does not guarantee that materials can be safely or successfully digitized, that the Digitization Station equipment will be compatible with any particular material or storage device, or that digitized files will be complete, accurate, or free from loss or corruption. Patron is responsible for determining whether Patron’s materials are suitable for use with the Digitization Station and for following all instructions provided by SJPL staff regarding the safe and proper use of the equipment. Patron knowingly and voluntarily assumes the risks associated with Patron’s use of the Digitization Station, including the risk of personal injury, and the loss of or damage to Patron’s materials, property, files, or data. SJPL is not responsible for the loss of or damage to personal property brought into the Digitization Station.
2. Release of Liability. Patron releases SJPL, its officers, agents, volunteers, board members and assigns from all liability whatsoever arising out of any damage, loss, or injury to Patron or Patron’s property while participating in any activity on the premises of SJPL and/or using any equipment owned by SJPL or another member or guest of SJPL regardless of whether such loss or injury is as a result of the negligence of SJPL or its members, guests, agents, volunteers and assigns, or is a result of some other cause.
3. Covenant Not to Sue. Patron agrees that Patron will not, under any circumstances, initiate any legal action against SJPL, its members, volunteers, guests, agents, and assigns, nor will Patron assist in the prosecution of any such legal action filed by another, arising out of an injury to the person or property of Patron while participating in the services or activities contemplated by use of SJPL or the Digitization Station. This covenant extends to include the heirs, executors, administrators, or assigns of Patron.
4. Third Party Indemnification. Patron agrees to indemnify, save, and hold harmless SJPL, its staff, volunteers, agents and assigns from all losses, claims, actions, or proceedings of every kind and character which may be initiated by any other persons or organizations, and which arise directly or indirectly from the actions of Patron while participating in the services or activities contemplated by use of SJPL or the Digitization Station.
By signing below, I (Patron) hereby acknowledge that I have carefully read the above SJPL Digitization Station Policy and Patron Release, fully understand the same, and voluntarily sign this document as a condition of using the Digitization Station at SJPL. (* Patrons under 18 years old must have signed parental/guardian consent.)
